    ORDER:-

    The Commissioner of Collegiate Education,A.P.,Hyderabad, in his Letter 3m read above, among other things, has stated that the Government College Gazetted Teachers' Association in their representation have represented certain issues regarding implementation of UGC Pay Scales. One of the issue is relating to allowing of UGC Scales to the Lecturers I Librarians I Physical Directors in terms of APCES Rules issued in G.O.Ms.No.47, Hr.(CE-1) Dept., dt.14-05-2007, wherein it was specified that NET I SLET shall remain the compulsory requirement for appointment as Lecturer.However, the candidates, who have M.Phil Degree are exempted for both P.G and U.G.level teaching. These orders are effective from the date of issue of G.O. i.e. w.e.f. 14-05-2007.This gives a meaning that those, who possess M.Phil or Ph.D as on 14-05-2007 i.e. from the date of issue of G.O.Ms.No.47, Hr. Edn. (CE-1) Dept. dt.14-05-2007 are exempted from acquiring of NET ISLET and are eligible for UGC scales.

    2.The Commissioner of Collegiate Education, A.P., Hyderabad,has also stated that the G.C.G.T.A's contention is that all those,who possess M.PhillPh.D as on the date of G.O. i.e.14-05-2007 are exempted from NET ISLET condition and also qualified for UGC Scales w.e.f.14-05-2007, inrespective of the date of acquiring the NET I SLET qualification.Earlier, Govt. in Memo.No.200451UE-II-1/2002-2, dated 07-05-2003 have exempted from passing NET ISLET for those Lecturers, who have completed M.Phil Degree by 31-12-1993 or have submitted Ph.D thesis in the subject concerned on or before 31-12-2002 and allowed UGC Scales. The Commissioner of Collegiate Education, A.P., Hyderabad, has sought for clarification on the following:-

    (a) As to whether the orders issued in G.O.Ms.No.47,Hr. Edn.(CE-1) Dept. dt.14-05-2007 may be made applicable in respect of Lecturers, who have M.Phil for allowing UGC Scales duly exempting from NET ISLET, if so, upto which date.

    (b) Whether the Lecturers, who have acquired M.Phil I Ph.D. through the distance mode are eligible or not for UGC Scales in terms of G.O.Ms.No.47, Hr.{CE-1) Dept. dt.14-05-2007.

    In G.0.41
    read above, Government have issued orders, amending the existing Note (4) of the A.P.C.E.S Rules issued in G.0.151 read above w.e.f.
    11-07-2009 namely:-

    In the said rules, in the Annexure -

    (1) for the existing Note (4), the following shall be substituted namely -

    (4) NET ISLET shall remain the minimum eligibility condition for recruitment and appointment of Lecturers in Government Degree Colleges I Government OrientalColleges "

    Provided, however,that candidates who are or have been awarded Ph.D degree in compliance of the University Grants Commission (minimum standards and procedure for award of Ph.D. Degree) Regulations, 2009 shall be exempted from the requirements of the minimum eligibility condition of NET I SLET for recruitments and appointment of Lecturers in Government Degree Colleges I Government Oriental Colleges".

    (2)in Note (6) the word "M.Phil.wherever it occurred shall be omitted.

    4.Government have examined the matter in terms of the orders issued in the G.O. 4th read above and accordingly, hereby clarify that the Lecturers, who are working in Government Degree Colleges, possessing M.Phil qualification prior to
    11-07-2009 and are drawing State Pay Scales are eligible to opt U.G.C Pay Scales. Further, the Lecturers working in Government Degree Colleges, who have acquired M.Phil I Ph.D through the distance mode are not eligible for UGC Pay Scales in terms of G.O.Ms.No.47, Higher Education (CE-1) Department, dated 14-05-2007, as clarified by the A.P.State Council of Higher Education, Hyderabad, in their Letter
    No.APSCHE/UM-740/Deemed Uni-Ciarifl2009, dated 15-01-2009.

    5.The Commissioner of Collegiate Education, A.P., Hyderabad, shall take necessary further action in the matter accordingly.
